DMCA / Copyright Policy

  1. Overview
    Total Highlights respects the intellectual property rights of others and expects users to do the same. This policy explains how to submit a Digital Millennium Copyright Act (DMCA) notice, how to file a counter notice, and how we address repeat infringement.

  2. Copyright Ownership and Content
    All original content on Total Highlights, including articles, graphics, and site design, is owned by or licensed to Total Highlights. Third party trademarks, team names, logos, and league marks are the property of their respective owners. We may reference or display limited materials for news reporting or commentary consistent with fair use where applicable.

  1. How to File a DMCA Takedown Notice
    If you believe that content on our website infringes your copyright, send a written notice to the Designated Agent that includes all items required by 17 U.S.C. § 512(c)(3):

a. A physical or electronic signature of the person authorized to act on behalf of the copyright owner.
b. Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are covered.
c. Identification of the material that is claimed to be infringing, and information reasonably sufficient to allow us to locate the material. Provide a specific URL or direct link.
d. Your contact information, including full name, mailing address, telephone number, and email address.
e. A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
f. A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on the owner’s behalf.

Incomplete notices may delay our response.

  1. What Happens After We Receive a Valid Notice
    Upon receiving a valid DMCA notice, we may remove or disable access to the reported material and notify the user who posted it. When feasible, we will forward the notice to that user. We may also terminate accounts or access for repeat infringers as described below.

  2. How to File a DMCA Counter Notice
    If your material was removed or disabled due to a DMCA notice and you believe the removal was a mistake or that you are authorized to use the material, you may file a counter notice with the Designated Agent. Your counter notice must include the items required by 17 U.S.C. § 512(g)(3):

a. Your physical or electronic signature.
b. Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before removal or disabling. Provide the specific URL if possible.
c. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled due to mistake or misidentification.
d. Your name, mailing address, telephone number, and email address.
e. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if outside the United States, that you consent to the jurisdiction of any judicial district in which Total Highlights may be found, and that you will accept service of process from the person who provided the original DMCA notice or that person’s agent.

After we receive a valid counter notice, we may restore the material in 10 to 14 business days unless the complaining party informs us that it has filed an action seeking a court order to restrain you from engaging in infringing activity.

  1. Repeat Infringer Policy
    In appropriate circumstances and at our sole discretion, Total Highlights may terminate or restrict access for users who are determined to be repeat infringers. We also reserve the right to remove content that appears to infringe the rights of others, even if we have not received a formal DMCA notice.

  2. Misrepresentations
    Under 17 U.S.C. § 512(f), any person who knowingly makes a material misrepresentation that material or activity is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys’ fees, incurred by the alleged infringer or by us.

  3. Preservation of Rights and No Legal Advice
    Nothing in this policy limits our ability to pursue other remedies. This policy is provided for informational purposes and does not constitute legal advice. You should consult your own legal counsel regarding your rights and obligations under the DMCA and other laws.

  4. Modifications to This Policy
    We may update this DMCA / Copyright Policy from time to time. Changes are effective when posted on this page with a revised Effective Date.
